We invite you to read carefully the present general conditions of use and general conditions of sale (hereinafter referred to as the "GCU/CGV") as well as our personal data protection policy in order to be able to browse and order on our website. The user, whether a natural person, customer or not, is hereby informed that he/she is bound by these terms and conditions.

The use of the services of our site, as well as any order, implies the prior, full and complete acceptance of these GTC/GVS and of our personal data protection policy, of which you acknowledge having been informed.

2. GENERAL TERMS AND CONDITIONS OF USE

 

Any access to and/or use of the www.berteil.com website implies compliance with all the provisions of these general conditions and their acceptance. They therefore constitute a contract between Berteil and the user/client.

 

2.1 DEFINITIONS

 

-Customer: is understood to be any natural person who is acting for purposes that do not fall within the scope of his or her commercial, industrial, artisanal or liberal activity, who is at least 18 years of age and who has ordered at least once on the site. The customer has a berteil.com customer account.


-Username: shall be understood to mean the e-mail address required to identify a user on the site in order to access his/her account.


-Password: shall be understood to mean the succession of characters that the user must keep secret and that allows him/her, together with his/her identifier, to access his/her account.


-Site: www.berteil.com


-User: means any person using the www.berteil.com website or any of the services offered on it.


-Identified user: is understood to mean any person using the www.berteil.com website or one of the services offered on it and having a Berteil account.

 

2.2 CONDITIONS OF ACCESS AND USE OF THE SITE

 

The site is accessible free of charge to any user with Internet access.


The user is responsible for his/her own computer equipment and internet access. All costs relating to access to the site shall be borne by the user/customer.


The user can only access his account after identification with his login and password. The user shall be obliged to keep his user name and password secret and shall not communicate them to a third party.


Berteil shall do everything in its power to ensure 24/7 access to the site, but cannot be held responsible for any problem or malfunction of the site that would prevent access to the site and/or the various services offered by Berteil.com. Berteil.com will do its utmost to resolve any problem as soon as possible.

Access to the services includes subscription to the Berteil.com newsletters. The identified user may, at any time, modify the information that he/she wishes to receive or unsubscribe by clicking on the link provided for this purpose at the bottom of each newsletter. This link is also accessible on the site in the "My personal information" section.


The creation of an account on the site is reserved for any natural person aged at least 18 years. Each user may only create one Berteil account.


All the fields in the account creation form must be filled in, with the exception of those indicated as optional. Any failure to answer will result in the account not being created. All information provided by the user must be accurate. The customer may enter any telephone number: office and/or mobile and/or home.


When the user creates an account on the site, he/she shall receive an e-mail confirming the creation of the account the same day. Berteil.com reserves the right to delete any account that does not comply with these contractual conditions.

 

3. GENERAL TERMS AND CONDITIONS OF SALE

 

The General Terms and Conditions of Sale define the conditions applicable to sales concluded between, on the one hand, persons making a purchase via the website www.berteil.com, hereinafter referred to as "the client" and, on the other hand, the company Berteil SAS, hereinafter referred to as "Berteil.com". These terms and conditions apply exclusively to natural persons who are not traders.

 

3.1 ITEM PRICES AND ORDERING

 

PRICES


All prices are indicated in euros including all taxes but excluding shipping costs.


The validity of the prices of the articles offered on Berteil.com is 24 hours from their publication on the site www.berteil.com. The articles shall be invoiced on the basis of the prices in force at the time of registration of the orders. They shall remain the property of Berteil.com until full payment has been received by Berteil.com. This price shall be payable in full (see paragraph "Retention of title").


ORDER


The client may place an order on the website www.berteil.com


The ordering process is as follows:


-selection of items and addition to the basket


-validation of the contents of the basket


-identification on the website www.berteil.com if the customer is not already identified


-choice of delivery method


-choice of payment method and acceptance of the GTC


-Confirmation of payment


The customer will be able to view the details of their order and its total price and correct any errors, before confirming it to express their acceptance.


The client shall receive an order confirmation e-mail.


Berteil.com reserves the ownership of the articles until the order has been paid in full, that is to say, until the price of the order has been received by Berteil.com.


Berteil.com reserves the right to cancel or refuse any order from a client with whom there is a dispute relating to the payment of a previous order or who presents any form of risk in its eyes.


Any order implies acceptance of the prices and description of the articles available for sale. Berteil.com undertakes to honour orders received on the website only within the limits of available stocks. If one or more items ordered are not available, Berteil.com undertakes to inform the Client as soon as possible and, where applicable, to reimburse the Client at the latest within 14 days of the date on which the Client exercised his right of withdrawal. The Client's order shall then be automatically cancelled.


Berteil.com reserves the right to verify the personal data communicated by the client and to adopt all measures deemed necessary to verify that the person who placed the order is indeed the person who holds the client account and/or the means of payment used, in order to avoid any identity theft or fraudulent payment.

 

3.2 SHIPPING AND DELIVERY

 

With the exception of sales periods and loyalty offers reserved for customers, any order placed on the Berteil.com website before 4 p.m. from Monday to Friday (excluding public holidays) will be prepared and dispatched the following day, subject to validation of payment (see paragraph "Validation of payment").


Berteil.com undertakes to deliver the items ordered and paid for by the client according to the following delivery methods and times:


Delivery in Metropolitan France, the Principality of Monaco and Andorra:


-tracked colissimo: 48h to 72h from dispatch*, Monday to Saturday


-Pickup relay: 48 to 72 hours from dispatch*.


The customer must check the condition of the items delivered.


Any anomaly concerning the items (damage, missing item compared to the order form, damaged or opened package, broken item, etc.) must be indicated within 3 days of delivery.


For any delivery in a Pickup Relay, the customer will have to check the contents of the parcel as well as the state of the articles at the Relay point before signing any delivery slip (paper or electronic). Any open or incomplete package and/or any damaged item shall not be accepted by the client. The client shall inform Berteil.com of the problem encountered.


All items offered by Berteil.com are subject to the legal guarantee provided for in Articles 1641 et seq. of the Civil Code (see paragraph "Guarantee").


Delivery costs are free for all deliveries in metropolitan France (including Corsica and Monaco).


The delivery costs for all deliveries outside mainland France will be specified to the customer during the final validation of the order.

 

 

3.3 PAYMENT

 

MEANS OF PAYMENT


Payment for purchases shall be made by Visa, MasterCard or Carte Bleue.


Berteil.com shall not refund cash in the event of the return of one or more articles. The corresponding card will automatically be credited with the corresponding amount by the partner concerned.


VALIDATION OF PAYMENT


Payment shall be validated upon receipt of the additional information requested in the event of payment by bank card requiring additional checks.


RECORDING OF BANK DETAILS


Berteil.com cannot, under any circumstances, record the bank details of its customers.


SECURITY OF TRANSACTIONS


Berteil.com uses all possible means to ensure the confidentiality and security of data transmitted on the web and on the website www.berteil.com. To this end, the website uses a secure SSL (Secure Socket Layer) payment module.


FIGHT AGAINST CREDIT CARD FRAUD


The information relating to your order is subject to automated data processing for which Berteil.com is responsible. The purpose of this automated data processing is to define a level of analysis of a transaction and to combat credit card fraud.


Berteil.com is the recipient of the data relating to your order. The non-transmission of data relating to your order prevents the completion and analysis of your transaction.


The occurrence of an unpaid order due to fraudulent use of a bank card shall result in the registration of the details relating to your order associated with this unpaid order in a payment incident file. An irregular declaration or an anomaly may also be subject to specific processing.


Berteil.com reserves the right to verify the personal data communicated by the client and to adopt all measures deemed necessary to verify that the person whose bank account is debited is indeed the person who placed the order, in order to avoid any fraudulent payment. This verification may take the form of a request for proof of identity and/or residence. If the client fails to respond to a request of this type within 2 days following the request made by Berteil.com, the order in question shall automatically be cancelled, without any possibility of subsequent complaint.


Berteil.com shall also be at liberty to proceed with the direct cancellation of an order which presents one or more risk factors of fraudulent use of a bank card.

 

 

3.4 RETURN AND REFUND

 

RIGHT OF WITHDRAWAL


Conditions


You have the right to withdraw from this contract without giving any reason within fourteen days of receiving the product. To exercise the right of withdrawal, you must notify us of your decision to withdraw from this contract by means of an unambiguous statement (e.g. letter sent by post or e-mail). You can use the model withdrawal form but this is not obligatory. For the withdrawal period to be respected, it is sufficient that you send your communication on the exercise of the right of withdrawal before the withdrawal period expires.


Effects of withdrawal


You must return the goods without undue delay and, in any event, no later than fourteen days after you have informed us of your decision to withdraw from this contract by using the return label provided to you. This period is deemed to have been respected if you return the goods before the expiry of the fourteen-day period.


You are only liable for the depreciation of the goods resulting from handling other than that necessary to establish the nature, characteristics and proper functioning of the goods.

Conditions of return for refund


The returned item(s) must be new, unused and in their original, undamaged box.


All returns must be requested from the "My personal information" section of the www.berteil.com website.


The customer may only make one online return request per order on the www.berteil.com website.


If the customer's order includes several items and he/she wishes to return more than one item, he/she must select all the items he/she wishes to be reimbursed for when making the return request.


The customer must return the unwanted items at their own expense within the time limit set for this purpose.


If the customer wishes to return items from different orders, he/she must separate the said items in different packages when returning them. Any return of items from different orders that do not comply with this condition cannot be processed within the timeframe stipulated in our GTC.


Condition of the items


All items returned (folders, original packaging, accessories, instructions, etc.) must be returned perfectly intact.


Upon receipt of the parcel, Berteil.com will judge the perfect condition of the returned goods. No returns shall be accepted if the items returned have been visibly used or damaged by the client and if this use or damage makes the items unfit for sale.

 

REFUND


If you withdraw from this contract, we will refund all payments received from you (except for any additional costs arising from the fact that you have chosen a method of delivery other than the cheaper standard method of delivery offered by us) without undue delay and in any event no later than fourteen days from the day we are informed of your decision to withdraw from this contract. We may defer the refund until we have received the goods. We will make the refund using the same method of payment that you used for the original transaction, unless you expressly agree to a different method; in any event, there will be no charge to you for this refund. No cash refund shall be made by Berteil.com in the event of the return of one or more articles. The corresponding card shall automatically be credited with the corresponding amount by the partner concerned.


In the event of receipt of a return parcel whose contents do not comply with the request for return or whose articles do not comply with the conditions for return mentioned above, Berteil.com reserves the right to take all corresponding recovery actions against the Client.


EXCEPTION


For reasons of hygiene and safety, the client may not exercise his right of withdrawal for the following articles:


-socks ;


-underwear, in particular boxer shorts, etc.


Berteil.com reserves the right to change this list.


RETURN OF THE GOOD PRODUCT


The customer must return the product purchased on the site www.berteil.com, new and unworn, for which he/she has exercised his/her right of withdrawal. If the client does not return the correct product, Berteil shall send him an email inviting him to collect it at his own expense within two months from the date of the email. After this period, Berteil shall consider itself to be the owner within the meaning of article 2276, paragraph 1 of the Civil Code which provides: "In the case of movable property, possession is equivalent to title" and shall reserve the right to destroy the property. Berteil shall not be held responsible for the fact of such destruction.


Furthermore, in the event of failure to return the goods which are the subject of the right of withdrawal, Berteil shall reserve the right to lodge a complaint for breach of trust (Article 314-1, paragraph 2 provides that: "Breach of trust is punishable by three years' imprisonment and a fine of 375,000 euros").

3.6 GUARANTEE

 

All items offered by Berteil.com are subject to the legal guarantee provided by Articles L 217-4 and following of the Consumer Code and to the guarantee for hidden defects provided by Articles 1641 and following of the Civil Code.


The customer has two years to make use of one or other of these guarantees. For the lack of conformity, the period runs from the date of delivery. For hidden defects, the period runs from the discovery of the defect.


If the apparent defect, the lack of conformity or the hidden defect of the article, declared by the client, if applicable, is proven, after an expert assessment, Berteil.com may proceed to repair or replace the Product. If this is not possible, Berteil.com shall reserve the right to reimburse the client at its own expense.


Berteil.com shall not be held responsible for the misuse and/or intensive use of the articles by the client. Similarly, Berteil.com shall not be held responsible for the return of a competing product and/or one not sold on the site by the client. It is the responsibility of the client to return the correct article.


Berteil.com does not offer a commercial guarantee.


Article L 217-4


The seller delivers a good in conformity with the contract and is responsible for any defects in conformity existing at the time of delivery.


He shall also be liable for any lack of conformity resulting from the packaging, the assembly instructions or the installation when the latter was made his responsibility by the contract or was carried out under his responsibility.


Article L 217-5


The good is in conformity with the contract:


1° If it is fit for the purpose usually expected of similar goods and, where applicable :


- if it corresponds to the description given by the seller and has the qualities that the seller presented to the buyer in the form of a sample or model;


- if it has the qualities that a buyer may legitimately expect in view of the public statements made by the seller, the producer or his representative, particularly in advertising or labelling;


2° Or if it has the characteristics defined by mutual agreement between the parties or is suitable for any special use sought by the buyer, brought to the attention of the seller and accepted by the latter.


Article L 217-12


The action resulting from the lack of conformity shall be prescribed by two years from the delivery of the goods.


Article L 217-16


When the buyer asks the seller, during the course of the commercial guarantee granted to him at the time of the acquisition or repair of a movable good, for a repair covered by the guarantee, any period of immobilisation of at least seven days shall be added to the duration of the guarantee that remained to run.


This period shall run from the date of the buyer's request for intervention or from the time the item in question is made available for repair, if this is later than the request for intervention.
 

 

3.7 LIABILITY

 

Berteil.com shall be responsible by operation of law to the client for the proper performance of the contract concluded with the client.


However, Berteil.com shall not be held liable for the non-performance or poor performance of the contract entered into in the event of force majeure, the occurrence of an event attributable to the client or any unforeseeable and insurmountable inconvenience or damage inherent in the use of the Internet network, in particular a break in service, an external intrusion or the presence of computer viruses.


The Berteil.com site contains hypertext links that may lead to other websites. Berteil.com cannot be held responsible for the content of these websites if they contravene the legal and regulatory provisions in force.

 

3.8 RESERVATION OF OWNERSHIP

 

Berteil.com shall remain the owner of the goods until full payment of the price by the client.

 

3.9 INTELLECTUAL PROPERTY

 

All texts, comments, works, illustrations and images reproduced on Berteil.com are reserved under copyright law and intellectual property law for the whole world. In this respect and in accordance with the provisions of the intellectual property code, only private use is authorised, subject to different, even more restrictive provisions of the intellectual property code. Any total or partial reproduction of the Berteil.com site is strictly forbidden without prior agreement.


3.10 MEDIATION


In accordance with Articles L 611-1 et seq. of the Consumer Code, the client shall have the right to have recourse free of charge (except for any legal and expert fees) to a consumer mediator with a view to the amicable resolution of a dispute with Berteil.


Since 15 February 2016, the European Commission's online platform for the amicable settlement of disputes is open to the public. Any consumer who has a dispute with a company located in the EU has the possibility to file a request for mediation through this European platform. 3.11 APPLICABLE LAW

 

The present general conditions of use and sale are subject to French law. In case of persistent disagreement on the application, interpretation and execution of these terms and conditions, and in the absence of an amicable agreement, any dispute will be referred to the competent French courts.

-On your mobile device, activate the limited ad tracking setting in the settings of your iOS phone or the setting to disable the display of personalised ads on your Android phone.


LEGAL OR REGULATORY REQUIREMENT


We may be required to disclose your personal data in response to legitimate requests from public authorities, including to meet national security, anti-fraud or law enforcement requirements.


PREVENTION AND FIGHT AGAINST FRAUD


The data collected shall also be used in the context of the prevention of and fight against fraud, in particular credit card fraud. Berteil reserves the right to verify the personal data communicated by the client when placing the order and to adopt all measures deemed necessary to verify that the person whose bank account is debited is indeed the person who placed the order, in order to avoid any fraudulent payment. This verification may take the form of a request for proof of identity and/or residence.


In the absence of a positive response from the client, Berteil reserves the right to cancel the order placed by the client.


COLLECTION OF DEBTS


If the client fails to pay the full amount due, it shall become an outstanding debt. For this purpose, we may be required to pass on your personal data to our debt collection service provider.


OTHER CASES


In all other cases, you will be notified of the processing that Berteil intends to carry out.

Any access to and/or use of the www.berteil.com website implies compliance with all the provisions of these general conditions and their acceptance. They therefore constitute a contract between Berteil and the user/client.

All information provided by the user must be accurate. The customer may enter any telephone number: office and/or mobile and/or home.


When the user creates an account on the site, he/she shall receive an e-mail confirming the creation of the account the same day. Berteil.com reserves the right to delete any account that does not comply with these contractual conditions.

 

3. GENERAL TERMS AND CONDITIONS OF SALE

 

The General Terms and Conditions of Sale define the conditions applicable to sales concluded between, on the one hand, persons making a purchase via the website www.berteil.com, hereinafter referred to as "the client" and, on the other hand, the company Berteil SAS, hereinafter referred to as "Berteil.com". These terms and conditions apply exclusively to natural persons who are not traders.

 

3.1 ITEM PRICES AND ORDERING

 

PRICES


All prices are indicated in euros including all taxes but excluding shipping costs.


The validity of the prices of the articles offered on Berteil.com is 24 hours from their publication on the site www.berteil.com. The articles shall be invoiced on the basis of the prices in force at the time of registration of the orders. They shall remain the property of Berteil.com until full payment has been received by Berteil.com. This price shall be payable in full (see paragraph "Retention of title").

The client may place an order on the website www.berteil.com


The ordering process is as follows:

-Confirmation of payment


The customer will be able to view the details of their order and its total price and correct any errors, before confirming it to express their acceptance.


The client shall receive an order confirmation e-mail.


Berteil.com reserves the ownership of the articles until the order has been paid in full, that is to say, until the price of the order has been received by Berteil.com.


Berteil.com reserves the right to cancel or refuse any order from a client with whom there is a dispute relating to the payment of a previous order or who presents any form of risk in its eyes.


Any order implies acceptance of the prices and description of the articles available for sale. Berteil.com undertakes to honour orders received on the website only within the limits of available stocks. If one or more items ordered are not available, Berteil.com undertakes to inform the Client as soon as possible and, where applicable, to reimburse the Client at the latest within 14 days of the date on which the Client exercised his right of withdrawal. The Client's order shall then be automatically cancelled.


Berteil.com reserves the right to verify the personal data communicated by the client and to adopt all measures deemed necessary to verify that the person who placed the order is indeed the person who holds the client account and/or the means of payment used, in order to avoid any identity theft or fraudulent payment.

 

3.2 SHIPPING AND DELIVERY

 

With the exception of sales periods and loyalty offers reserved for customers, any order placed on the Berteil.com website before 4 p.m. from Monday to Friday (excluding public holidays) will be prepared and dispatched the following day, subject to validation of payment (see paragraph "Validation of payment").


Berteil.com undertakes to deliver the items ordered and paid for by the client according to the following delivery methods and times:


Delivery in Metropolitan France, the Principality of Monaco and Andorra:


-tracked colissimo: 48h to 72h from dispatch*, Monday to Saturday


-Pickup relay: 48 to 72 hours from dispatch*.


The customer must check the condition of the items delivered.


Any anomaly concerning the items (damage, missing item compared to the order form, damaged or opened package, broken item, etc.) must be indicated within 3 days of delivery.


For any delivery in a Pickup Relay, the customer will have to check the contents of the parcel as well as the state of the articles at the Relay point before signing any delivery slip (paper or electronic). Any open or incomplete package and/or any damaged item shall not be accepted by the client. The client shall inform Berteil.com of the problem encountered.


All items offered by Berteil.com are subject to the legal guarantee provided for in Articles 1641 et seq. of the Civil Code (see paragraph "Guarantee").


Delivery costs are free for all deliveries in metropolitan France (including Corsica and Monaco).


The delivery costs for all deliveries outside mainland France will be specified to the customer during the final validation of the order.

 

3.3 PAYMENT

 

MEANS OF PAYMENT


Payment for purchases shall be made by Visa, MasterCard or Carte Bleue.


Berteil.com shall not refund cash in the event of the return of one or more articles. The corresponding card will automatically be credited with the corresponding amount by the partner concerned.


VALIDATION OF PAYMENT


Payment shall be validated upon receipt of the additional information requested in the event of payment by bank card requiring additional checks.


RECORDING OF BANK DETAILS


Berteil.com cannot, under any circumstances, record the bank details of its customers.


SECURITY OF TRANSACTIONS


Berteil.com uses all possible means to ensure the confidentiality and security of data transmitted on the web and on the website www.berteil.com. To this end, the website uses a secure SSL (Secure Socket Layer) payment module.


FIGHT AGAINST CREDIT CARD FRAUD


The information relating to your order is subject to automated data processing for which Berteil.com is responsible. The purpose of this automated data processing is to define a level of analysis of a transaction and to combat credit card fraud.


Berteil.com is the recipient of the data relating to your order. The non-transmission of data relating to your order prevents the completion and analysis of your transaction.


The occurrence of an unpaid order due to fraudulent use of a bank card shall result in the registration of the details relating to your order associated with this unpaid order in a payment incident file. An irregular declaration or an anomaly may also be subject to specific processing.


Berteil.com reserves the right to verify the personal data communicated by the client and to adopt all measures deemed necessary to verify that the person whose bank account is debited is indeed the person who placed the order, in order to avoid any fraudulent payment. This verification may take the form of a request for proof of identity and/or residence. If the client fails to respond to a request of this type within 2 days following the request made by Berteil.com, the order in question shall automatically be cancelled, without any possibility of subsequent complaint.


Berteil.com shall also be at liberty to proceed with the direct cancellation of an order which presents one or more risk factors of fraudulent use of a bank card.

 

 

3.4 RETURN AND REFUND

 

RIGHT OF WITHDRAWAL


Conditions


You have the right to withdraw from this contract without giving any reason within fourteen days of receiving the product. To exercise the right of withdrawal, you must notify us of your decision to withdraw from this contract by means of an unambiguous statement (e.g. letter sent by post or e-mail). You can use the model withdrawal form but this is not obligatory. For the withdrawal period to be respected, it is sufficient that you send your communication on the exercise of the right of withdrawal before the withdrawal period expires.


Effects of withdrawal


You must return the goods without undue delay and, in any event, no later than fourteen days after you have informed us of your decision to withdraw from this contract by using the return label provided to you. This period is deemed to have been respected if you return the goods before the expiry of the fourteen-day period.


You are only liable for the depreciation of the goods resulting from handling other than that necessary to establish the nature, characteristics and proper functioning of the goods.

Conditions of return for refund


The returned item(s) must be new, unused and in their original, undamaged box.


All returns must be requested from the "My personal information" section of the www.berteil.com website.


The customer may only make one online return request per order on the www.berteil.com website.


If the customer's order includes several items and he/she wishes to return more than one item, he/she must select all the items he/she wishes to be reimbursed for when making the return request.


The customer must return the unwanted items at their own expense within the time limit set for this purpose.


If the customer wishes to return items from different orders, he/she must separate the said items in different packages when returning them. Any return of items from different orders that do not comply with this condition cannot be processed within the timeframe stipulated in our GTC.


Condition of the items


All items returned (folders, original packaging, accessories, instructions, etc.) must be returned perfectly intact.


Upon receipt of the parcel, Berteil.com will judge the perfect condition of the returned goods. No returns shall be accepted if the items returned have been visibly used or damaged by the client and if this use or damage makes the items unfit for sale.

 

REFUND


If you withdraw from this contract, we will refund all payments received from you (except for any additional costs arising from the fact that you have chosen a method of delivery other than the cheaper standard method of delivery offered by us) without undue delay and in any event no later than fourteen days from the day we are informed of your decision to withdraw from this contract. We may defer the refund until we have received the goods. We will make the refund using the same method of payment that you used for the original transaction, unless you expressly agree to a different method; in any event, there will be no charge to you for this refund. No cash refund shall be made by Berteil.com in the event of the return of one or more articles. The corresponding card shall automatically be credited with the corresponding amount by the partner concerned.


In the event of receipt of a return parcel whose contents do not comply with the request for return or whose articles do not comply with the conditions for return mentioned above, Berteil.com reserves the right to take all corresponding recovery actions against the Client.


EXCEPTION


For reasons of hygiene and safety, the client may not exercise his right of withdrawal for the following articles:


-socks ;


-underwear, in particular boxer shorts, etc.


Berteil.com reserves the right to change this list.


RETURN OF THE GOOD PRODUCT


The customer must return the product purchased on the site www.berteil.com, new and unworn, for which he/she has exercised his/her right of withdrawal. If the client does not return the correct product, Berteil shall send him an email inviting him to collect it at his own expense within two months from the date of the email. After this period, Berteil shall consider itself to be the owner within the meaning of article 2276, paragraph 1 of the Civil Code which provides: "In the case of movable property, possession is equivalent to title" and shall reserve the right to destroy the property. Berteil shall not be held responsible for the fact of such destruction.


Furthermore, in the event of failure to return the goods which are the subject of the right of withdrawal, Berteil shall reserve the right to lodge a complaint for breach of trust (Article 314-1, paragraph 2 provides that: "Breach of trust is punishable by three years' imprisonment and a fine of 375,000 euros").

3.6 GUARANTEE

 

All items offered by Berteil.com are subject to the legal guarantee provided by Articles L 217-4 and following of the Consumer Code and to the guarantee for hidden defects provided by Articles 1641 and following of the Civil Code.


The customer has two years to make use of one or other of these guarantees. For the lack of conformity, the period runs from the date of delivery. For hidden defects, the period runs from the discovery of the defect.


If the apparent defect, the lack of conformity or the hidden defect of the article, declared by the client, if applicable, is proven, after an expert assessment, Berteil.com may proceed to repair or replace the Product. If this is not possible, Berteil.com shall reserve the right to reimburse the client at its own expense.


Berteil.com shall not be held responsible for the misuse and/or intensive use of the articles by the client. Similarly, Berteil.com shall not be held responsible for the return of a competing product and/or one not sold on the site by the client. It is the responsibility of the client to return the correct article.


Berteil.com does not offer a commercial guarantee.


Article L 217-4


The seller delivers a good in conformity with the contract and is responsible for any defects in conformity existing at the time of delivery.


He shall also be liable for any lack of conformity resulting from the packaging, the assembly instructions or the installation when the latter was made his responsibility by the contract or was carried out under his responsibility.

The good is in conformity with the contract:


1° If it is fit for the purpose usually expected of similar goods and, where applicable :


- if it corresponds to the description given by the seller and has the qualities that the seller presented to the buyer in the form of a sample or model;


- if it has the qualities that a buyer may legitimately expect in view of the public statements made by the seller, the producer or his representative, particularly in advertising or labelling;


2° Or if it has the characteristics defined by mutual agreement between the parties or is suitable for any special use sought by the buyer, brought to the attention of the seller and accepted by the latter.


Article L 217-12


The action resulting from the lack of conformity shall be prescribed by two years from the delivery of the goods.

When the buyer asks the seller, during the course of the commercial guarantee granted to him at the time of the acquisition or repair of a movable good, for a repair covered by the guarantee, any period of immobilisation of at least seven days shall be added to the duration of the guarantee that remained to run.


This period shall run from the date of the buyer's request for intervention or from the time the item in question is made available for repair, if this is later than the request for intervention.
 

 

3.7 LIABILITY

 

Berteil.com shall be responsible by operation of law to the client for the proper performance of the contract concluded with the client.


However, Berteil.com shall not be held liable for the non-performance or poor performance of the contract entered into in the event of force majeure, the occurrence of an event attributable to the client or any unforeseeable and insurmountable inconvenience or damage inherent in the use of the Internet network, in particular a break in service, an external intrusion or the presence of computer viruses.


The Berteil.com site contains hypertext links that may lead to other websites. Berteil.com cannot be held responsible for the content of these websites if they contravene the legal and regulatory provisions in force.

 

3.8 RESERVATION OF OWNERSHIP

 

Berteil.com shall remain the owner of the goods until full payment of the price by the client.

 

3.9 INTELLECTUAL PROPERTY

 

All texts, comments, works, illustrations and images reproduced on Berteil.com are reserved under copyright law and intellectual property law for the whole world. In this respect and in accordance with the provisions of the intellectual property code, only private use is authorised, subject to different, even more restrictive provisions of the intellectual property code. Any total or partial reproduction of the Berteil.com site is strictly forbidden without prior agreement.


3.10 MEDIATION


In accordance with Articles L 611-1 et seq. of the Consumer Code, the client shall have the right to have recourse free of charge (except for any legal and expert fees) to a consumer mediator with a view to the amicable resolution of a dispute with Berteil.


Since 15 February 2016, the European Commission's online platform for the amicable settlement of disputes is open to the public. Any consumer who has a dispute with a company located in the EU has the possibility to file a request for mediation through this European platform. LEGAL OR REGULATORY REQUIREMENT

PREVENTION AND FIGHT AGAINST FRAUD


The data collected shall also be used in the context of the prevention of and fight against fraud, in particular credit card fraud. Berteil reserves the right to verify the personal data communicated by the client when placing the order and to adopt all measures deemed necessary to verify that the person whose bank account is debited is indeed the person who placed the order, in order to avoid any fraudulent payment. In the absence of a positive response from the client, Berteil reserves the right to cancel the order placed by the client.

If the client fails to pay the full amount due, it shall become an outstanding debt. For this purpose, we may be required to pass on your personal data to our debt collection service provider.
